US Senate pushes CLARITY Act vote to September

By Diego Whitfield · · 1 min read

The US Senate has delayed its vote on the CLARITY Act until September, pushing back one of the most closely watched pieces of crypto market structure legislation as lawmakers run short on time before their August recess.

A Delayed Vote

Senate Majority Leader John Thune confirmed the postponement, describing the move as "punting" the vote to September. The decision means the digital asset industry will have to wait longer for the regulatory certainty many firms have been demanding for years.

The CLARITY Act aims to establish a clear framework for how digital assets are classified and regulated in the United States, dividing oversight responsibilities and defining when a token should be treated as a security versus a commodity.

The industry's long-awaited regulatory roadmap now hinges on a crowded autumn legislative calendar.

What's at Stake

Supporters of the bill argue that a defined market structure would remove much of the ambiguity that has driven crypto companies to seek friendlier jurisdictions abroad. Without clear rules, firms have faced enforcement actions and uncertainty over which agency governs their operations.

The delay adds the legislation to an already busy fall schedule, where it will compete for floor time with other pressing priorities. Advocates worry that further postponements could stall momentum built earlier in the year.

Key issues still on the table include:

  • How to split regulatory authority between the SEC and the CFTC
  • Defining the line between securities and commodities
  • Establishing compliance pathways for token issuers

For now, the crypto sector must wait until September to see whether the Senate can advance one of the most significant efforts to formalize oversight of the industry.
