U.S. Senator Lummis says Democrats won't quit asking for more on crypto Clarity Act

By Diego Whitfield · · 2 min read

U.S. Senator Cynthia Lummis, one of Washington's leading voices on cryptocurrency legislation, says she has reached her limit on making further concessions to Democrats over the Clarity Act, the sweeping market structure bill she has championed for more than half a decade.

Negotiations Hit a Wall

The Wyoming Republican, a longtime advocate for digital assets, expressed frustration over what she characterized as an endless cycle of demands from Democratic lawmakers seeking additional revisions to the legislation. After more than five years of work on the measure, Lummis suggested that the process of accommodating new requests has become unsustainable.

The Clarity Act aims to establish a comprehensive regulatory framework for the crypto industry, addressing long-standing questions about how digital assets should be classified and which agencies should oversee them. Market structure legislation has been a top priority for the industry, which has long complained about regulatory uncertainty in the United States.

"I've run out of gas on new revisions," Lummis signaled, underscoring how far negotiations have stretched.

The Path Forward for Market Structure

Lummis's comments reflect the ongoing tension in Congress as lawmakers attempt to craft bipartisan legislation that can pass both chambers. Democrats have continued to push for stronger provisions, particularly around consumer protections and oversight, while Republicans and industry backers press for a framework they say will bring clarity and keep innovation onshore.

The senator's remarks suggest that reaching a final agreement could prove challenging, as the two sides remain divided over key elements of the bill. Her position indicates that the window for further compromise may be narrowing.

Key sticking points in the debate have included:

  • How digital assets are classified under securities and commodities law
  • The division of regulatory authority between federal agencies
  • Consumer protection safeguards demanded by Democratic negotiators

With the crypto industry watching closely, the fate of the Clarity Act may hinge on whether lawmakers can bridge their remaining differences before the legislative calendar runs short.
