EU Regulator Says Prediction Markets Are 'Rife With Inside Trading'

By Diego Whitfield · · 2 min read

A top European Union financial watchdog has raised sharp concerns about the growing prediction market industry, warning that platforms like Polymarket and Kalshi may be plagued by insider trading and inconsistent geographic restrictions across the bloc.

Regulator Sounds the Alarm

The European Securities and Markets Authority, known as ESMA, has flagged prediction markets as being "rife with inside trading," casting doubt on the integrity of a sector that has surged in popularity in recent years. The regulator's remarks underscore mounting scrutiny of platforms that let users bet on real-world outcomes ranging from elections to economic data.

Insider trading has long been a concern in traditional financial markets, where individuals with non-public information can exploit their knowledge for profit. ESMA's comments suggest similar dynamics may be at play in prediction markets, where participants with advance knowledge of certain events could gain an unfair edge over ordinary users.

The watchdog warns that prediction markets may be undermined by the same insider abuses that plague traditional finance.

Questions Over Access and Enforcement

Beyond insider trading, ESMA questioned why major platforms such as Kalshi and Polymarket restrict access in some EU member states while leaving others open. The uneven approach has drawn regulatory attention, with the watchdog seeking clarity on the rationale behind the patchwork of blocks.

The regulator also pointed out that existing geographic restrictions are easily circumvented. Users can rely on virtual private networks, or VPNs, to mask their location and access platforms even in jurisdictions where they are officially blocked.

That reality highlights a broader enforcement challenge for regulators trying to police borderless online platforms. Technical barriers intended to keep certain users out often prove ineffective against determined participants armed with widely available tools.

Key concerns raised by ESMA include:

  • Widespread potential for insider trading on prediction platforms
  • Inconsistent access restrictions across EU member states
  • The ease of bypassing blocks using VPN technology

What Comes Next

The comments signal that European regulators are paying closer attention to prediction markets as they scale globally. Both Kalshi and Polymarket have expanded their reach, and continued regulatory pressure could shape how these platforms operate within the EU going forward. For now, ESMA's warning adds to a growing chorus of official skepticism about the sector's oversight and fairness.
