Trade groups seek to block Illinois crypto tax before January effective date

By Priya Chen · · 2 min read

Two prominent cryptocurrency trade organizations are asking a court to halt an Illinois tax on digital asset transactions before it takes effect in January, escalating a legal fight over what they call an unconstitutional levy.

The Legal Challenge

The Crypto Council for Innovation (CCI) and the Blockchain Association have filed for an injunction to prevent the state from enforcing a proposed 0.2% tax on crypto transactions. The move builds on an earlier lawsuit the groups brought against Illinois officials, and it aims to stop the measure before its scheduled effective date at the start of the year.

The plaintiffs argue that the tax runs afoul of constitutional protections and would place a heavy and expensive compliance burden on companies operating in the digital asset space. They contend that firms would struggle to track and report the required data across the vast number of transactions the industry processes.

The trade groups say the levy is not only costly to comply with but fundamentally unconstitutional.

What's at Stake

For the crypto sector, the outcome could set a precedent for how individual states approach taxing digital asset activity. A patchwork of differing state-level rules has long been a concern for the industry, which favors clearer federal guidance over conflicting local requirements.

The trade associations warn that the compliance costs tied to the Illinois measure could be significant, potentially discouraging businesses from serving customers in the state or forcing them to overhaul their reporting systems.

Key elements of the dispute include:

  • A proposed 0.2% tax on crypto transactions
  • An effective date scheduled for January
  • Claims that the tax is unconstitutional
  • Concerns over steep compliance obligations

With the January deadline approaching, the request for an injunction adds urgency to the litigation, as both sides prepare for a decision that could shape state crypto policy well beyond Illinois.
