Thailand moves closer to Bitcoin, Ether ETFs with draft rules

By Diego Whitfield · · 2 min read

Thailand's securities regulator has taken a significant step toward launching spot Bitcoin and Ether exchange-traded funds, opening public consultations on a draft framework that would govern the products and set qualification standards for foreign digital asset custodians.

A Regulated Path for Crypto Investment

The Securities and Exchange Commission of Thailand is seeking feedback on rules that would allow local asset managers to create ETFs tracking the two largest cryptocurrencies by market value. The move would give Thai investors regulated exposure to Bitcoin and Ether without requiring them to hold the assets directly or navigate crypto exchanges.

The proposed framework marks a notable shift for the Southeast Asian nation, which has generally approached digital assets with caution while acknowledging growing investor demand. If finalized, the rules would place Thailand among a small but expanding group of jurisdictions offering exchange-traded crypto products.

Thailand is inching toward mainstream crypto access, wrapping Bitcoin and Ether in a familiar, regulated investment wrapper.

Custody Standards and Public Input

A central part of the consultation focuses on qualification requirements for foreign digital asset custodians. Establishing clear custody standards is widely seen as essential for protecting investors and ensuring that the underlying assets backing any ETF are securely held.

The SEC's decision to open the matter to public consultation reflects a broader trend among regulators seeking industry and stakeholder input before implementing crypto-related policies. Feedback gathered during this period is expected to shape the final version of the rules.

Key elements under review include:

  • Draft rules for local Bitcoin and Ether ETFs
  • Qualification standards for foreign digital asset custodians
  • Investor protection and secure asset storage requirements

Should the framework advance, Thailand would join other markets that have embraced spot crypto ETFs as demand for regulated digital asset products continues to build across the region.
