SEC to review Nasdaq bitcoin options approval after CME challenge

By Diego Whitfield · · 1 min read

The U.S. Securities and Exchange Commission has agreed to reconsider its approval of a Nasdaq proposal to list bitcoin options, following a challenge from the CME Group that questions whether the agency even has authority over the products.

The Jurisdictional Dispute

At the heart of the matter is a fundamental question about which regulator holds sway over bitcoin-linked derivatives. CME contends that because bitcoin is classified as a commodity, options tied to its value should fall under the oversight of the Commodity Futures Trading Commission rather than the SEC.

The argument strikes at a long-running turf battle between the two agencies over how to regulate digital assets. If bitcoin is treated as a commodity, the reasoning goes, then instruments deriving their value from it belong under commodity market rules enforced by the CFTC.

The fight over bitcoin options is really a fight over who gets to police crypto's fastest-growing markets.

What Happens Next

By agreeing to review the earlier approval, the SEC has effectively paused the path for Nasdaq to bring its bitcoin options to market while it weighs the objections raised by CME. Such reviews give the commission room to reaffirm, modify, or reverse its original decision.

The outcome could carry broad implications for how spot-based crypto derivatives are structured and where they trade in the United States. A ruling in CME's favor would bolster the CFTC's claim over crypto products, while a decision upholding the approval would strengthen the SEC's footing.

Key issues in play include:

  • Whether bitcoin's status as a commodity limits the SEC's reach
  • How derivatives referencing that asset should be classified
  • Which venues can ultimately list and trade bitcoin options

For now, market participants await clarity as the regulatory tug-of-war over crypto continues to unfold.
