Crypto industry urges SEC to avoid blanket novel ETF restrictions

Leading crypto firms and industry advocates are pressing the U.S. Securities and Exchange Commission to resist adopting sweeping restrictions on novel exchange-traded products, warning that a one-size-fits-all approach could stifle innovation and slow the arrival of new investment vehicles.

Industry Pushback on Blanket Rules

Grayscale, venture capital firm a16z, and the Crypto Council for Innovation (CCI) have each urged the regulator to keep existing classification frameworks intact rather than lumping all new exchange-traded products together as a single category. Their central argument is that treating diverse financial instruments under one umbrella risks applying overly broad limitations that fail to account for meaningful differences between products.

The firms contend that novel ETFs and similar structures vary widely in their underlying assets, risk profiles, and market behavior. Grouping them indiscriminately, they argue, could lead to unnecessary hurdles for products that pose little concern while doing nothing to improve investor protection.

Lumping every new product into one bucket ignores the very differences that regulation is meant to address.

Proposals for Faster, Clearer Reviews

Rather than simply opposing new constraints, the industry participants have offered constructive alternatives aimed at making the SEC's review process more efficient and transparent. Each group proposed its own path toward clearer standards that would allow legitimate products to reach the market more quickly.

The recommendations reflect a broader industry frustration with what many see as an unpredictable and lengthy approval process. By preserving current rules and refining how reviews are conducted, the firms believe regulators can maintain oversight without erecting blanket barriers.
