CLARITY Act could get another shot during lame-duck session, policy advocate says

By Diego Whitfield · · 2 min read

The CLARITY Act, a stalled crypto market structure bill, may see renewed momentum during the upcoming lame-duck session of Congress, according to a policy advocate who says bipartisan support could revive the legislation before the current session concludes.

Renewed Push for Market Structure Legislation

Adrian Wall, managing director of the Digital Sovereignty Alliance, indicated that lawmakers from both major parties are weighing another effort to move the crypto market structure bill forward. The window for action would come during the lame-duck session, the period after elections when the outgoing Congress remains in office before new members are seated.

The CLARITY Act aims to establish clearer rules for how digital assets are regulated in the United States, addressing a long-standing gap in oversight that has left much of the industry uncertain about which federal agencies hold authority over various tokens and platforms.

Bipartisan interest suggests the bill still has life despite earlier setbacks.

What's at Stake for the Industry

Market structure legislation has been a top priority for the crypto sector, which has repeatedly called for regulatory certainty. Supporters argue that a defined framework would help distinguish between assets treated as securities and those handled as commodities, clarifying the roles of regulators.

According to Wall, the possibility of senators from both sides of the aisle backing another attempt reflects continued appetite for reform even as the legislative calendar tightens. Passing complex financial legislation during a lame-duck session, however, can be challenging given competing priorities and limited time.

Key considerations facing lawmakers include:

  • Defining agency jurisdiction over digital assets
  • Balancing consumer protection with industry growth
  • Securing enough bipartisan votes before the session ends

Whether the bill advances will depend on legislative will and the ability of its backers to build consensus in the remaining days of the current Congress.
