CFTC and SEC Double Down on Crypto After Clarity Act Defeat

U.S. financial regulators are signaling they won't wait for Congress to act on crypto, with leaders at both the Commodity Futures Trading Commission and the Securities and Exchange Commission vowing to lean on their existing authority following the Senate's failure to advance landmark digital asset legislation.

Regulators Step In After Legislative Stall

CFTC acting Chairman Michael Selig and SEC Chairman Paul Atkins both pledged to move forward using the tools already at their disposal, rather than let the industry linger in regulatory limbo after the Clarity Act stalled in the Senate. The bill had been widely viewed as the best chance to establish a clear framework dividing oversight of digital assets between the two agencies.

The setback leaves the crypto sector without the comprehensive market structure legislation many firms had been hoping for. But instead of treating the defeat as a dead end, the two regulators framed it as a reason to accelerate their own efforts.

"We won't sit on our hands waiting for Congress — we'll use the powers we already have."

Using Existing Powers for Certainty

Both officials emphasized that their agencies can provide meaningful guidance and certainty without new statutory authority. That approach could involve rulemaking, no-action relief, and clearer interpretations of how existing securities and commodities laws apply to digital assets.

The move reflects a broader shift in tone from Washington regulators, who under new leadership have signaled a more constructive posture toward the crypto industry compared with the enforcement-heavy years that preceded them.

Key priorities emerging from the two agencies include:

  • Clarifying the jurisdictional lines between securities and commodities
  • Offering guidance that firms can rely on while legislation remains stalled
  • Reducing the uncertainty that has pushed some crypto businesses offshore

Still, the reliance on existing powers carries limits. Without congressional action, any regulatory framework built through agency discretion could be vulnerable to legal challenges or reversal under future administrations — leaving the long-term certainty the industry craves still out of reach.
